Vacation Rental Terms and Conditions
Ellijay, Georgia | Coosawattee River Resort
Owner: Hidengocreek LLC | Property Manager: Luxe Hospitality Group LLC | Effective October 2026 (Rev. 3)
1. AGREEMENT AND PARTIES
These Terms and Conditions (the "Agreement") govern the short-term rental of the Hide'n Go Creek cabin in Ellijay, Georgia (the "Property"). The Property is owned by Hidengocreek LLC (the "Owner") and managed by Luxe Hospitality Group LLC (the "Manager"), which acts as property manager and agent for the Owner. "Guest" means the person making the reservation and every member of the Guest's party, each of whom is bound by this Agreement.
This Agreement becomes binding when the Guest submits payment or accepts these terms at booking, whichever occurs first. The Guest occupies the Property as a licensee of the Owner, not as a tenant, and acquires no leasehold or other interest in the Property.
2. BOOKING CHANNEL
Direct bookings. Reservations made directly through hidengocreek.com or the Manager are subject to every section of this Agreement, including the payment schedule, cancellation and refund policy, and security deposit terms in Sections 4 through 7.
Bookings through an online travel agency (OTA): Cancellation and refund policy varies by OTA booking site. Refer to the policy referenced on your booking site. For reservations made through Airbnb, Vrbo, or any other third-party platform, that platform's payment schedule, cancellation and refund policy, and damage or security deposit terms control. All other sections of this Agreement, including occupancy limits, house rules, conduct, and fees for violations, apply to OTA reservations to the extent permitted by the booking platform's policies.
3. ELIGIBILITY AND OCCUPANCY
The Guest making the reservation must be at least twenty-five (25) years of age and must be present at the Property for the entire stay. By booking, the Guest confirms both.
Maximum occupancy is eight (8) guests. The Guest must submit a complete guest list, including children, before arrival instructions are released. Only persons on the guest list may be at the Property, and day visitors may not cause the number of persons on site to exceed maximum occupancy at any time. Exceeding maximum occupancy is a material breach of this Agreement and may result in removal from the Property without refund. Roll-away beds, inflatable mattresses, and sleeping bags are prohibited unless approved by the Manager in advance.
4. RATES, TAXES, AND FEES
The total reservation amount consists of the nightly rate, the cleaning fee, any processing fee displayed at booking, and all applicable Georgia state and local sales, lodging, and hotel-motel taxes and fees. By providing payment information, the Guest authorizes the Manager to charge the payment method on file for the reservation amount in accordance with the payment schedule below, and for any additional charges incurred under this Agreement (see Schedule A).
5. PAYMENT SCHEDULE (DIRECT BOOKINGS)
- At booking: 30% of the total reservation amount is due.
- Balance: the remaining 70% is due five (5) days before the arrival date and will be charged automatically to the payment method on file.
- Late bookings: reservations made fewer than five (5) days before arrival are due in full at the time of booking.
If the balance cannot be collected by its due date, the Manager may cancel the reservation, and the cancellation and refund policy in Section 6 will apply to amounts already paid.
6. CANCELLATION AND REFUND POLICY (DIRECT BOOKINGS)
Refunds are calculated on prepayments actually received, based on when written notice of cancellation is received by the Manager:
| Cancellation received | Refund of paid prepayments |
|---|---|
| 30 or more days before arrival | 100% |
| 14 to 29 days before arrival | 50% |
| Fewer than 14 days before arrival | 0% (non-refundable) |
Cancellations and date changes must be submitted in writing and confirmed by the Manager. A change of dates is treated as a cancellation of the original reservation and a new booking, subject to availability and current rates. If a reservation is canceled within the non-refundable period and the Manager re-rents the same dates, the Manager may, at its sole discretion, refund a portion of the amount paid; no refund is guaranteed.
No refunds, credits, or rebates are given for late arrival, early departure, no-shows, members of the party who do not attend, or failure to follow the arrival instructions. No refunds are given for weather, including snow and ice, road conditions, acts of God, government action, utility or internet outages, or other circumstances outside the Manager's control. The Manager strongly recommends that Guests purchase travel insurance. If the Manager or Owner cancels a reservation for reasons other than the Guest's breach, the Guest will receive a full refund of all amounts paid, which is the Guest's sole remedy.
7. SECURITY DEPOSIT OR DAMAGE WAIVER (DIRECT BOOKINGS)
A pre-authorization of $250.00 will be placed on the Guest's payment method one (1) day before arrival. This is a hold, not a charge, and will be voided five (5) days after departure if no charges are owed. The Guest authorizes the Manager to capture all or part of the hold for damage beyond normal wear and tear, missing items, additional cleaning, or any fee under Schedule A. Amounts owed in excess of $250.00 will be charged to the payment method on file. The Manager will notify the Guest and provide an itemized description, with supporting photos where applicable, before any charge is made.
Damage waiver option. In lieu of the security deposit pre-authorization, the Guest may elect to purchase a one-time damage waiver for the length of the stay for a non-refundable fee of $75.00 per stay, under the terms of Hidengocreek Guest Damage Waiver. The waiver does not cover damage caused intentionally, recklessly, or through gross negligence, violations of this Agreement, or the charges listed in Schedule A, all of which remain the Guest's responsibility and will be charged to the payment method on file.
For OTA reservations, damage and incidental charges will be pursued through the booking platform's resolution process.
8. CHECK-IN AND CHECK-OUT
Check-in is at 4:00 PM and check-out is by 11:00 AM. The Property will not be available before check-in time. Early check-in or late check-out may be requested and is subject to availability and the Manager's written approval. Unapproved early arrival or late departure authorizes the Manager to charge up to one (1) night's rental rate. Guests are asked to follow the check-out procedures provided in the house manual.
9. ARRIVAL, ACCESS, AND DIRECTIONS
Arrival instructions. Arrival instructions, including gate registration details, driving directions, and the Guest's door access code, are sent once the reservation is paid in full and the guest list has been submitted.
Gated community. The Property is located inside the Coosawattee River Resort, a gated community. Guests must check in at the security gate using the guest name and lot number provided in the arrival instructions. The lot number differs from the street address. Additionally, a guest pass will be issued prior to arrival and must be displayed to the gate attendant upon arrival.
Roads. Roads to the Property are winding mountain roads, and the final approximately three-quarter mile is gravel. Guests unfamiliar with mountain roads are strongly encouraged to arrive before dark on their first visit. Cell service can be unreliable in the area; save or print the directions before departing. Neither the Owner nor the Manager is responsible for road conditions or for a Guest's inability to locate the Property when directions have been provided, and no refunds will be given for either.
Keyless entry. The Property uses a keypad smart lock. The Guest's unique code is valid for the duration of the stay only and may not be shared with anyone outside the registered party. Guests must lock the door whenever they leave the Property and at departure. If the access code does not work, contact the Manager for an alternate access solution. Damage to the lock, or a service call caused by misuse, will be charged at actual cost.
10. RESORT COMMUNITY RULES
Guests must comply with all rules and regulations of the Coosawattee River Resort, including speed limits, gate procedures, and amenity rules. Any fine or charge assessed against the Owner by the resort association as a result of the conduct of the Guest's party will be charged to the Guest. Operation of ATVs, off-road motorcycles, or dirt bikes is prohibited.
11. SUPPLIES AND WHAT TO BRING
Each stay includes a starter supply of three (3) rolls of toilet paper and one (1) roll of paper towels. Depending on the length of stay, Guests should bring additional paper products, ice, firewood, and spices and ingredients for meals. Wi-Fi is provided at no charge; network credentials are included in the arrival instructions.
12. HOUSE RULES AND CONDUCT
- No parties or events. The Property is a private residence and may not be used for parties, reunions, weddings, or other gatherings.
- Quiet hours are 10:00 PM to 8:00 AM. Sound carries in the mountains; Guests must not disturb neighbors at any time.
- No smoking or vaping of any substance inside the cabin. Smoking indoors, or leaving cigarette butts on the grounds, will result in an odor-abatement and cleanup charge of not less than $250.
- Pets. Only dogs are allowed, with prior approval from the Manager, for a non-refundable pet fee of $100.00 per stay. A maximum of two (2) dogs are allowed during the stay. A pet found on the Property without prior approval is a breach of this Agreement and will result in a charge of not less than $250 plus the cost of any damage. Service animals are accommodated as required by applicable law and booking platform policy.
- Alcohol and drugs. Consumption of alcohol by anyone under twenty-one (21) and use of illegal drugs are prohibited and are grounds for immediate removal without refund.
- Firearms, fireworks, and projectiles. Discharging firearms, BB or pellet guns, paintball guns, or fireworks on or near the Property is prohibited.
- Furnishings. Furniture is arranged as the Owner intends. Please return any moved furniture to its original position before check-out.
13. GARBAGE
All garbage must be bagged in 13-gallon kitchen bags or larger and placed in the outdoor cans, with lids closed and secured to deter wildlife. The waste hauler will not collect loose garbage; unbagged garbage or garbage left outside the cans will result in a $50 cleanup charge.
14. CLEANING
The Property is cleaned and inspected before each arrival. Guests must leave the Property in a reasonably clean, undamaged condition and follow the check-out procedures. If the Property requires cleaning beyond the normal turnover (for example, carpet or upholstery cleaning, or food left in cookware), an additional cleaning charge may apply. The Guest will be notified before that charge is made.
15. AMENITIES
Television and streaming. Channel and streaming availability is not guaranteed. Guests who sign into personal streaming accounts do so at their own risk and should sign out before departure. If equipment is disconnected or reconfigured and a service call is required, the Guest will be charged not less than $50.
Grill. The grill is fueled by propane only. Do not add charcoal or any charcoal product.
Fireplace and fire pit. Never leave a burning or smoldering fire unattended. Firewood is not provided; Guests must bring their own. Burn only firewood: no trash, lighter fluid, or other materials. Gas log units, where present, may not be moved, re-stacked, or used to burn anything else. Guests must comply with any burn ban in effect. Violations that result in a fine by the authorities will be the responsibility of the Guest.
Hot tub (where provided). Use is at the Guest's own risk. Children must be supervised by an adult at all times. Do not add any objects or chemicals. A Guest-requested mid-stay cleaning is $50. Posted hot tub rules must be followed.
16. CREEK AND OUTDOOR RECREATION
The Property sits directly on Mountaintown Creek. Water levels and currents can rise quickly and without warning after rain, including rain upstream. There is no lifeguard. Wading, swimming, tubing, fishing, and any other use of the creek is entirely at the Guest's own risk. Children must be supervised by an adult at all times near the water, and Guests must stay out of the creek during high or fast-moving water. Guests are responsible for holding any required Georgia fishing license.
17. WILDLIFE AND INSECTS
The Property is in the mountains, and Guests may encounter bears, deer, turkeys, snakes, scorpions, ticks, chiggers, wasps, carpenter bees, ladybugs, ants, and other wildlife and insects depending on the season. Guests should dress appropriately, bring insect repellent, and never feed wildlife. No refunds will be given for wildlife or insect encounters.
18. MAINTENANCE AND UTILITIES
Guests must notify the Manager promptly of any equipment breakdown, damage, or defect. The Manager will make every reasonable effort to resolve problems in a timely manner but cannot guarantee uninterrupted heat, air conditioning, electricity, water, internet, appliances, electronics, or other systems, and no refunds or rebates will be given for their failure. If a repair is needed because of a Guest's misuse, neglect, or oversight, the cost of the service call and repair will be charged to the Guest.
Construction, road repair, and routine maintenance (such as mowing or leaf removal) may occur in the area or at the Property during a stay. Work at the Property will not begin before 9:00 AM, and every effort will be made to minimize disruption. No refunds will be given for these inconveniences.
19. RIGHT OF ENTRY
The Manager and its contractors may enter the Property during a stay with reasonable advance notice to make repairs or perform maintenance, and without notice in an emergency or when the Manager has reason to believe this Agreement is being violated, including to verify occupancy or investigate a disturbance or damage.
20. ITEMS LEFT BEHIND
Neither the Owner nor the Manager is responsible for items left at the Property. If items are found, the Manager will attempt to contact the Guest. Return shipping is charged at a $25 handling fee plus actual shipping cost. Unclaimed items will be discarded or donated after seven (7) days.
21. INTERNET USE
Wi-Fi is provided as a courtesy, "as is" and "as available," without warranty of any kind. Neither the Owner nor the Manager is responsible for slow or interrupted service, and the Guest's sole remedy for dissatisfaction is to stop using it. The service may not be used for any unlawful purpose. The Guest is responsible for all use of the service by members of the party, including minors, and agrees to indemnify the Owner and Manager against any claim arising from that use. Access ends at check-out.
22. VIOLATIONS AND REMOVAL
Any material breach of this Agreement, including exceeding maximum occupancy, hosting a party, damaging the Property, creating a nuisance or breach of the peace, endangering any person, or violating any law or resort rule, entitles the Manager to terminate the Guest's license to occupy the Property and require the Guest's party to leave immediately, with forfeiture of all amounts paid. A Guest who fails to leave when the license is terminated, or who remains after the scheduled check-out, is a trespasser, and the Manager may request assistance from law enforcement. Reservations obtained by fraud or misrepresentation, including about the purpose of the stay or the number of guests, will be canceled with forfeiture of all amounts paid, and the party will not be permitted to check in.
23. ASSUMPTION OF RISK, INDEMNIFICATION, AND LIMITATION OF LIABILITY
The Guest assumes all risk of injury, illness, loss, or damage arising from the use of the Property, its furnishings and amenities, the creek, and any recreational activity, and should inspect and understand the proper use of any item before using it. The Guest is responsible for all damage to the Property, and for any injury or loss to any person or property, caused by the Guest's party. To the fullest extent permitted by law, the Guest agrees to indemnify, defend, and hold harmless the Owner, the Manager, and their respective members, managers, employees, and agents from all claims, including claims by third parties, and all related costs and reasonable attorneys' fees, arising out of or related to the Guest's party's use of the Property, except to the extent caused by the gross negligence or willful misconduct of the indemnified party. Neither the Owner nor the Manager is responsible for loss of or damage to personal property, including money and jewelry. In no event shall the liability of the Owner or Manager exceed the total amount paid for the reservation.
24. AGENCY DISCLOSURE AND NON-DISCRIMINATION
Luxe Hospitality Group LLC acts as property manager and agent for Hidengocreek LLC and acts at all times in the Owner's interest. The Manager reserves the right to refuse service to anyone for any lawful reason. The Property is rented without regard to race, color, religion, sex, national origin, disability, or familial status. Information in the Property's listings is believed to be accurate but is not guaranteed.
25. GOVERNING LAW AND VENUE
This Agreement is governed by the laws of the State of Georgia and is deemed executed in Gilmer County, Georgia. Any action relating to this Agreement shall be brought only in the state courts located in Gilmer County, Georgia, and the Guest consents to that jurisdiction and to service of process outside the State of Georgia.
26. GENERAL
This Agreement, together with the reservation confirmation and the house rules posted at the Property, is the entire agreement between the parties regarding the stay and supersedes all prior terms, including any terms issued under a prior management company. If any provision is found unenforceable, the remaining provisions remain in full effect. The Manager's failure to enforce any provision is not a waiver of it. By completing a reservation, the Guest confirms that the Guest has read, understands, and agrees to this Agreement on behalf of every member of the party.
